SB40-ASA1, s. 2670 4Section 2670. 343.50 (2) of the statutes is amended to read:
SB40-ASA1,1434,95 343.50 (2) Who may apply. Any resident of this state who does not possess a
6valid operator's license which contains the resident's photograph issued under this
7chapter may apply to the department for an identification card pursuant to this
8section. The card is not a license for purposes of this chapter and is to be used for
9identification purposes only.
SB40-ASA1, s. 2671 10Section 2671. 343.50 (3) of the statutes is amended to read:
SB40-ASA1,1434,2311 343.50 (3) Design and contents of card. The card shall be the same size as
12an operator's license but shall be of a design which is readily distinguishable from
13the design of an operator's license and bear upon it the words "IDENTIFICATION
14CARD ONLY".." The information on the card shall be the same as specified under
15s. 343.17 (3). If the issuance of the card requires the applicant to present any
16documentary proof specified in s. 343.14 (2) (es) 4. to 7., the card shall display, on the
17front side of the card, a legend identifying the card as temporary. The card shall
18contain physical security features consistent with any requirement under federal
19law.
The card may serve as a document of gift under s. 157.06 (2) (b) and (c) and the
20holder may affix a sticker thereto as provided in s. 343.175 (3). The card may also
21serve as a document of refusal to make an anatomical gift under s. 157.06 (2) (i). The
22card shall contain the holder's photograph and, if applicable, shall be of the design
23specified under s. 343.17 (3) (a) 12.
SB40-ASA1, s. 2672 24Section 2672. 343.50 (4) of the statutes, as affected by 2005 Wisconsin Act 126,
25is amended to read:
SB40-ASA1,1435,10
1343.50 (4) Application. The application for an identification card shall include
2any information required under ss. 85.103 (2) and 343.14 (2) (a), (b), (bm), (br), (em),
3and (er) (es), and such further information as the department may reasonably
4require to enable it to determine whether the applicant is entitled by law to an
5identification card. The Except with respect to renewals described in s. 343.165 (4)
6(d), the
department shall, as part of the application process, take a digital
7photograph including facial image capture of the applicant to comply with sub. (3).
8No Except with respect to renewals described in s. 343.165 (4) (d), no application may
9be processed without the photograph being taken. Misrepresentations in violation
10of s. 343.14 (5) are punishable as provided in s. 343.14 (9).
SB40-ASA1, s. 2673 11Section 2673. 343.50 (5) of the statutes, as affected by 2005 Wisconsin Act 126,
12is amended to read:
SB40-ASA1,1435,2313 343.50 (5) Valid period; fees. The fee for an original card and for the
14reinstatement of an identification card after cancellation under sub. (10) shall be $9
15$18. The card shall be valid for the succeeding period of 4 8 years from the
16applicant's next birthday after the date of issuance, except that a card that is issued
17to a person who is not a United States citizen and who provides documentary proof
18of legal status as provided under s. 343.14 (2) (er) shall expire on the date that the
19person's legal presence in the United States is no longer authorized. If the
20documentary proof as provided under s. 343.14 (2) (er) does not state the date that
21the person's legal presence in the United States is no longer authorized, then the card
22shall be valid for the succeeding period of 4 8 years from the applicant's next
23birthday after the date of issuance.
SB40-ASA1, s. 2674
1Section 2674 . 343.50 (5) of the statutes, as affected by 2005 Wisconsin Act 126
2and 2007 Wisconsin Act .... (this act), is renumbered 343.50 (5) (a) and amended to

15United States is no longer authorized or on the expiration date determined under
16par. (b), whichever date is earlier
. If the documentary proof as provided under s.
17343.14 (2) (er) (es) does not state the date that the person's legal presence in the
18United States is no longer authorized, then the card shall be valid for the succeeding
19period of 8 years from the applicant's next birthday after the date of issuance
20specified in par. (b) except that, if the card was issued or renewed based upon the
21person's presenting of any documentary proof specified in s. 343.14 (2) (es) 4. to 7.,
22the card shall, subject to s. 343.165 (4) (c), expire one year after the date of issuance
23or renewal
.
SB40-ASA1, s. 2675 24Section 2675. 343.50 (5m) of the statutes is created to read:

1343.50 (5m) Federal security verification mandate fee. In addition to any
2other fee under this section, for the issuance of an original identification card or
3duplicate identification card or for the renewal or reinstatement of an identification
4card after cancellation under sub. (10), a federal security verification mandate fee of

17identification card shall be $18, which card shall be valid for 8 years, except that a

19documentary proof of legal status as provided under s. 343.14 (2) (er) shall expire on
20the date that the person's legal presence in the United States is no longer authorized.
21If the documentary proof as provided under s. 343.14 (2) (er) does not state the date
22that the person's legal presence in the United States is no longer authorized, then
23the card shall be valid for 8 years.
SB40-ASA1, s. 2677 24Section 2677 . 343.50 (6) of the statutes, as affected by 2005 Wisconsin Act 126,
25is amended to read:

SB40-ASA1, s. 2678 14Section 2678 . 343.50 (8) (a) of the statutes is amended to read:
SB40-ASA1,1439,215 343.50 (8)(a) The department shall maintain current records of all
16identification card holders under this section in the same manner as required under
17s. 343.23 for operator's licenses. For each identification card applicant, the record
18shall include any application for an identification card received by the department,
19any reinstatement or cancellation of an identification card by the department, the
20information in all data fields printed on any identification card issued to the
21applicant, a record of the date on which any verification specified in s. 343.165 (1) and
22(3) was completed, and all documents required to be maintained under s. 343.165 (2)
23(a). The department shall maintain the digital images of documents specified in s.
24343.165 (2) (a) for at least 10 years. Records under this paragraph shall be

1maintained in an electronic and transferable format accessible for the purpose
2specified in par. (c) 1.
SB40-ASA1, s. 3387m 3Section 3387m. 343.50 (8) (b) of the statutes is amended to read:
SB40-ASA1,1439,174 343.50 (8) (b) The department may not disclose any record or other information
5concerning or relating to an applicant or identification card holder to any person
6other than a court, district attorney, county corporation counsel, city, village, or town
7attorney, law enforcement agency, driver licensing agency of another jurisdiction, the
8applicant or identification card holder or, if the applicant or identification card holder
9is under 18 years of age, his or her parent or guardian. Except for photographs
10disclosed to a law enforcement agency for which disclosure is authorized under s.
11343.237, persons entitled to receive any record or other information under this
12paragraph shall not disclose the record or other information to other persons or
13agencies. This paragraph does not prohibit the disclosure of a person's name or
14address, of the name or address of a person's employer or of financial information
15that relates to a person when requested under s. 49.22 (2m) by the department of
16workforce development children and families or a county child support agency under
17s. 59.53 (5).
SB40-ASA1, s. 2679 18Section 2679. 343.50 (8) (c) of the statutes is created to read:
SB40-ASA1,1439,2319 343.50 (8) (c) 1. Notwithstanding par. (b) and ss. 343.027, 343.14 (2j), and
20343.237 (2), the department shall, upon request, provide to the driver licensing
21agencies of other jurisdictions any record maintained by the department of
22transportation under this subsection, including providing electronic access to any
23such record.

25request, provide to the department of health and family services any applicant

1information maintained by the department of transportation and identified in s.
2343.14 (2), including providing electronic access to the information, for the sole
3purpose of verification by the department of health and family services of birth

SB40-ASA1, s. 2680 6Section 2680. 343.50 (10) (intro.) and (a) of the statutes are amended to read:
SB40-ASA1,1440,87 343.50 (10) Cancellation. (intro.) The department shall cancel an
8identification card under any of the following circumstances:
SB40-ASA1,1440,109 (a) Whenever the department determines that the card was issued upon an
10application which contains a false statement as to any material matter ; or.
SB40-ASA1, s. 2681 11Section 2681. 343.50 (10) (c) of the statutes is created to read:
SB40-ASA1,1440,1612 343.50 (10) (c) Whenever the department receives information from a local,
13state, or federal government agency that the card holder no longer satisfies the
14requirements for issuance of a card under ss. 343.14 (2) (es) and 343.165 (1) (e). A
15card cancelled under this paragraph may not be reinstated under sub. (5) until these
16requirements are again satisfied.
SB40-ASA1, s. 3390m 17Section 3390m. 343.51 (1) of the statutes is amended to read:
SB40-ASA1,1441,1318 343.51 (1) Any person who qualifies for a registration plates plate of a special
19design under s. 341.14 (1), (1a), (1m) or (1q) or any other person with a disability that
20limits or impairs the ability to walk may request from the department a special
21identification card that will entitle any motor vehicle, other than a motorcycle,
22parked by, or under the direction of, the person, or a motor vehicle, other than a
23motorcycle, operated by or on behalf of the organization when used to transport such
24a person, to parking privileges under s. 346.50 (2), (2a) and (3). The department shall
25issue the card at a fee to be determined by the department, upon submission by the

1applicant, if the applicant is an individual rather than an organization, of a
2statement from a physician licensed to practice medicine in any state, from an
3advanced practice nurse licensed to practice nursing in any state, from a physician
4assistant licensed or certified to practice in any state, from a chiropractor licensed
5to practice chiropractic in any state or from a Christian Science practitioner residing
6in this state and listed in the Christian Science journal that the person is a person
7with a disability that limits or impairs the ability to walk. The statement shall state
8whether the disability is permanent or temporary and, if temporary, the opinion of
9the physician, advanced practice nurse, physician assistant, chiropractor or
10practitioner as to the duration of the disability. The department shall issue the card
11upon application by an organization on a form prescribed by the department if the
12department believes that the organization meets the requirements under this
13subsection.
SB40-ASA1, s. 2682 14Section 2682. 343.61 (2) (a) 1m. of the statutes is amended to read:
SB40-ASA1,1441,2015 343.61 (2) (a) 1m. In the case of an individual who does not have a social
16security number, a statement made or subscribed under oath or affirmation that the
17individual does not have a social security number. The form of the statement shall
18be prescribed by the department of workforce development children and families. A
19license that is issued by the department in reliance on a statement submitted under
20this subdivision is invalid if the statement is false.
SB40-ASA1, s. 2683 21Section 2683. 343.61 (2) (b) of the statutes is amended to read:

18license issued under s. 343.61 or instructor's license issued under s. 343.62 or refuse
19to renew a driver school license or instructor's license if the applicant or licensee is
20an individual who is delinquent in making court-ordered payments of child or family
21support, maintenance, birth expenses, medical expenses or other expenses related
22to the support of a child or former spouse, or who fails to comply, after appropriate
23notice, with a subpoena or warrant issued by the department of workforce
24development
children and families or a county child support agency under s. 59.53

1(5) and related to paternity or child support proceedings, as provided in a
2memorandum of understanding entered into under s. 49.857.
SB40-ASA1, s. 2687 3Section 2687. 344.18 (1) (intro.) of the statutes is amended to read:
SB40-ASA1,1443,114 344.18 (1) (intro.) Any registration suspended or revoked under s. 344.14 shall
5remain suspended or revoked and shall not be renewed or reinstated until the person
6pays the fee required under s. 341.36 (1m), meets one of the requirements under pars.
7(a) to (d) and satisfies the requirements of sub. (1m). Any operating privilege
8suspended or revoked under s. 344.14 shall remain suspended or revoked and shall
9not be reinstated until the person pays the fee fees required under s. 343.21 (1) (j)
10and (n), complies with the applicable provisions of s. 343.38 and meets any of the
11following requirements:
SB40-ASA1, s. 2688 12Section 2688. 344.18 (3) (intro.) of the statutes is amended to read:
SB40-ASA1,1443,2313 344.18 (3) (intro.) If a person defaults in the payment of any installment under
14a duly acknowledged written agreement, the secretary, upon notice of such default
15given in no event later than 30 days after the time for final installment, shall
16immediately suspend the registrations and operating privilege of the defaulting
17person. A suspension or revocation of registration under this subsection shall
18remain in effect until the person pays the fee required under s. 341.36 (1m), meets
19the requirement under par. (a) or (b) and satisfies the requirements of sub. (3m). A
20suspension or revocation of an operating privilege under this subsection shall remain
21in effect until the person pays the fee fees required in s. 343.21 (1) (j) and (n), complies
22with the applicable provisions of s. 343.38 and meets any of the following
23requirements:
SB40-ASA1, s. 2689 24Section 2689. 344.19 (3) of the statutes is amended to read:

1344.19 (3) Upon receipt of such certification from another state to the effect
2that the operating privilege or registration of a resident of this state has been
3suspended or revoked in such other state under a law providing for its suspension
4or revocation for failure to deposit security for payment of judgments arising out of
5a motor vehicle accident, under circumstances which would require the secretary to
6suspend a nonresident's operating privilege or registration had the accident occurred
7in this state, the secretary shall suspend the operating privilege of such resident if
8he or she was the operator and all of his or her registrations if he or she was the owner
9of a motor vehicle involved in such accident. The department may accept a
10certification which is in the form of a combined notice of required security and
11suspension order, but shall not suspend a resident's operating privilege or
12registration on the basis of such order until at least 30 days have elapsed since the
13time for depositing security in the other state expired. A suspension or revocation
14of operating privilege under this section shall continue until such resident furnishes
15evidence of his or her compliance with the law of the other state relating to the
16deposit of security, pays the fee fees required under s. 343.21 (1) (j) and (n) and
17complies with the applicable provisions of s. 343.38. A suspension or revocation of
18registration under this section shall continue until such resident furnishes evidence
19of his or her compliance with the law of the other state relating to the deposit of
20security, pays the fee required under s. 341.36 (1m) and satisfies the requirements
21of sub. (3m).
SB40-ASA1, s. 3419g 22Section 3419g. 344.45 (1) of the statutes is amended to read:
SB40-ASA1,1445,423 344.45 (1) Whenever a person's operating privilege or registration is suspended
24under this chapter, the department may order the person to surrender to the
25department his or her operator's license and the registration plates plate of the any

1vehicle or vehicles for which registration was suspended. If the person fails
2immediately to return the operator's license or registration plates plate to the
3department, the department may direct a traffic officer to take possession thereof
4and return them to the department.
SB40-ASA1, s. 3419r 5Section 3419r. 344.55 (2) of the statutes is amended to read:
SB40-ASA1,1445,136 344.55 (2) The department may not issue a registration plates plate for such
7a vehicle unless there is on file with the department a certificate of insurance
8showing that the vehicle is insured in compliance with sub. (1). No such policy may
9be terminated prior to its expiration or canceled for any reason unless a notice thereof
10is filed with the department at least 30 days prior to the date of termination or
11cancellation. The department shall suspend the registration of a vehicle on which
12the insurance policy has been terminated or canceled, effective on the date of
13termination or cancellation.
SB40-ASA1, s. 2690 14Section 2690. 345.47 (1) (c) of the statutes is amended to read:
SB40-ASA1,1445,2515 345.47 (1) (c) If a court or judge suspends an operating privilege under this
16section, the court or judge shall immediately take possession of the suspended license
17and shall forward it to the department together with the notice of suspension, which
18shall clearly state that the suspension was for failure to pay a forfeiture, plus costs,
19fees, and surcharges imposed under ch. 814. The notice of suspension and the
20suspended license, if it is available, shall be forwarded to the department within 48
21hours after the order of suspension. If the forfeiture, plus costs, fees, and surcharges
22imposed under ch. 814, are paid during a period of suspension, the court or judge
23shall immediately notify the department. Upon receipt of the notice and payment
24of the reinstatement fee fees under s. 343.21 (1) (j) and (n), the department shall
25return the surrendered license.
SB40-ASA1, s. 3429b
1Section 3429b. 346.50 (2) of the statutes is amended to read:
SB40-ASA1,1446,132 346.50 (2) Except as provided in sub. (3m), a motor vehicle bearing a special
3registration plate issued under s. 341.14 (1) or (1r) (a) to a disabled veteran or on his
4or her behalf is exempt from any ordinance imposing time limitations on parking in
5any street or highway zone and parking lot, whether municipally owned or leased,
6or both municipally owned and leased or a parking place owned or leased, or both
7owned and leased by a municipal parking utility, with one-half hour or more
8limitation but otherwise is subject to the laws relating to parking. Where the time
9limitation on a metered stall is one-half hour or more, no meter payment is required.
10Parking privileges granted by this subsection are limited to the disabled veteran to
11whom or on whose behalf the special plates were plate was issued and to qualified
12operators acting under the disabled veteran's express direction with the disabled
13veteran present.
SB40-ASA1, s. 3429d 14Section 3429d. 346.50 (2a) (intro.) of the statutes is amended to read:

8issued under s. 343.51 is displayed or a motor vehicle registered in another
9jurisdiction upon which is displayed a registration plate, a card or an emblem issued
10by the other jurisdiction designating the vehicle as a vehicle used by a person with
11a physical disability is exempt from s. 346.505 (2) (a) or any ordinance in conformity
12therewith prohibiting parking, stopping or standing upon any portion of a street,
13highway or parking facility reserved for persons with physical disabilities by official
14traffic signs indicating the restriction. Stopping, standing and parking privileges
15granted by this subsection are limited to the persons listed under subs. (2) and (2a)
16(a) to (m).

23card or emblem issued by the other jurisdiction which designates the vehicle as a
24vehicle used by a physically disabled person.

5signs indicating the restriction, for vehicles displaying a special registration plates
6plate issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a special
7identification card issued under s. 343.51 or vehicles registered in another
8jurisdiction and displaying a registration plate, card or emblem issued by the other
9jurisdiction which designates the vehicle as a vehicle used by a physically disabled
10person.

18card issued under s. 343.51 or vehicles registered in another jurisdiction and
19displaying a registration plate, card or emblem issued by the other jurisdiction which
20designates the vehicle as a vehicle used by a physically disabled person.

25marked as and intended to be an access aisle to provide entry to and exit from

2any portion of a street, highway or parking facility reserved, by official traffic signs
3indicating the restriction, for vehicles displaying a special registration plates plate
4issued under s. 341.14 (1), (1a), (1e), (1m), (1q) or (1r) (a) or a special identification
5card issued under s. 343.51 or vehicles registered in another jurisdiction and
6displaying a registration plate, card or emblem issued by the other jurisdiction which
7designates the vehicle as a vehicle used by a person with a physical disability.
